Proposed re-use of existing premises for restaurant and takeaway business. Specifically, we are seeking Council's determination: 1. The use of the premises as a restaurant is or is not development (in respect of use, i.e. not a material change of use from the permitted use); 2. Whether the proposed use as a restaurant having a complimentary takeaway use is or is not development (in respect of use, i.e. not a material change of use); and/or 3. In the event that items 1 and 2 above were deemed to be 'development', whether any such 'development' is 'exempted development' under Article 10 of the Planning and Development Regulations, 2001-2025.
